2012-13 Fees Consultation

Proposals for regulatory fees for On-Demand Programme Services for the period 1 April 2012 to 31 March 2013

This is a  consultation by the Authority for Television On Demand (“ATVOD”), the body that Ofcom designated on 18 March 2010 as the co-regulator for VOD editorial content. The purpose of this consultation is to consult on options for the setting of regulatory fees for on-demand programme services (“ODPS”) for the period 1 April 2012 to 31 March 2013. ODPS are defined in section 368A of the Communications Act 2003 (“the Act”) and are subject to regulation by Ofcom and ATVOD.

Under section 368NA of the Act, the aggregate amount of such fees must be sufficient to enable ATVOD and  Ofcom to meet, but not exceed, the likely costs of carrying out the relevant functions during that year. Any fee must also represent the appropriate contribution of the provider towards meeting those likely costs and must be justifiable and proportionate having regard to the provider who will be required to pay it and the functions in respect of which it is imposed.

The consultation document sets out proposals and options for such fees and seeks stakeholders views. Depending on the outcome of the consultation, a different basis for fees than was adopted for the period 1 April 2011 to 31 March 2012 may result.

The proposals and options put forward in the consultation document are proposed as the appropriate options to consider for the 2012-13 Fees. Although this is an ATVOD consultation, the ultimate responsibility for approving the 2012-13 Fees remains with Ofcom. For the avoidance of doubt, this consultation does not deal with what would be an appropriate amount and structure of regulatory fees beyond 31 March 2013.
