Proposal to adopt new Rules and Guidance in light of amendments made to the Communications Act 2003 by the Audiovisual Media Services Regulations 2014

This is a consultation by the Authority for Television On Demand (“ATVOD”), the body that Ofcom designated on 18 March 2010 as the co-regulator for VOD editorial content. The purpose of this consultation is to consult on a proposal to adopt an amended “Rules and Guidance” document.  

Since September 2010, ATVOD has published “Rules and Guidance” setting out the statutory requirements with which providers of On Demand Programme Services (“ODPS") must comply. The Rules as outlined replicate the relevant provisions of the amended Communications Act 2003, and are accompanied by non-binding interpretative guidance.

The Audiovisual Media Services Regulations 2014 (the “2014 Regulations”) further amend the Communications Act 2003 (“The Act”), introducing new provisions relevant to providers of ODPS. It is therefore proposed that ATVOD’s “Rules and Guidance” be updated to reflect these changes. ATVOD seeks the views of stakeholders on its proposal.

Responses must be received by 5pm on 2 March 2015 and will normally be published on this page shortly after receipt.

We expect to publish a statement on the Proposed Rules and Guidance in spring 2015.
